1. Introduction

1. CollectorsPost.com is an online web site (the 'Site') where individuals or companies ('Buyers') can find goods or items to purchase. This Buyer's Agreement ('Agreement') lists the terms of the Agreement between the Buyer ('you') and CollectorsPost.com ('we' or 'us') for the buying of goods, and all other services we provide (the 'services'). By checking 'I accept', you confirm that you accept the terms and conditions of this Agreement when purchasing items from this Site.
2. If any changes are made to this Agreement, we shall post on the Site a complete, revised version of this Agreement that will replace the terms contained in this Agreement. The revised version of the Agreement is automatically effective 14 days after it is first posted on the Site. After the posting of the revised agreement, your continued use of this Site and the services provided by CollectorsPost.com will signify your acceptance of the revised Agreement. If you do not accept the terms of the revised version of this Agreement, you should not continue to make use of this Site.
3. This Agreement incorporates the Guidelines also found on this Site relating to the procedure to be adopted by Buyers.

2. Becoming a Buyer

1. To be a Buyer at CollectorsPost.com, you must be at least 18 years old. You can use the services only if you can legally enter into and form binding contracts. If you do not qualify (for example, if you are under 18 years of age), you must not use the services provided on the Site.
2. Any request to buy goods will not be accepted unless you are a registered buyer. To register, you must provide your real name, address, phone number and email address. Registration data is kept private in accordance with the terms of this Agreement and our Privacy Policy. When you register with us, you authorize CollectorsPost.com and our online bank, WorldPay, to make any inquiries necessary to validate your credit information.
3. We will require you to give a password to access the Site and use the services. Passwords are kept private in accordance with our Privacy Policy. Beyond our site and that of our online bank, you are solely responsible for preserving the security of your password. You should not disclose your password to any other person because you are responsible for any sales, purchases or any other action that uses your email address and password. It is advisable, therefore, to select a password that another person would be unable to deduce. It is advisable, therefore, not to use parts of your real name or address.

3. Buying items

1. A Buyer offers to buy an item at the listed price plus the agreed shipping price by completing a purchase using the CollectorsPost.com shopping basket.
2. When an offer is made, you authorize your credit card to be charged an amount equal to the listing price and shipping cost of the item (or items). To ensure that funds are available to make the necessary payment, the Buyer's credit card will be immediately charged with the cost of the item (or items) and the shipping charge. Credit-card information is only available to our online bank, WorldPay, and is not retained by CollectorsPost.com
3. After the Buyer has made an offer and the Buyer's credit card has been charged, CollectorsPost.com receives a notification that a sale has been made and is given the Buyer's name and address to permit the shipping of the item to the Buyer.
4. If a Buyer is dissatisfied with any part of the purchase (including the condition of goods received), the Buyer must follow the dispute procedure listed in our Buyer Guidelines.

4. Prohibitions

1. Any fraudulent or illegal action taken by a member will be reported to an appropriate law-enforcement agency and CollectorsPost.com will cooperate fully in ensuring the prosecution of offenders.

5. Limitations of CollectorsPost.com's Liability

1. CollectorsPost.com disclaims any responsibility for any consequential, incidental and exemplary damages that may result from the sale, distribution or use of any goods or items.
2. CollectorsPost.com reserved the right to modify, discontinue (temporarily or permanently) the Site or any part of the Site with or without notice. You agree that we shall not be liable to you or any third party for any the modification or discontinuance of the Site or the services provided under this Agreement.
3. The intellectual property of our Site belongs to CollectorsPost.com. You acknowledge and agree that nothing in this Agreement confers to you any right of ownership or use of out intellectual property, including trademarks.

6. Conclusion

The software and the Site, including without limitation all text, graphics, logos, buttons, icons, images, audio clips, and computer programs, are the property of CollectorsPost.com or its suppliers, and are protected by U.S. and international copyright, trademark and other laws.
2. Except as expressly stated otherwise, all notices to CollectorsPost.com shall be sent to the email addresses provided on the Site (e.g., alldrama@CollectorsPost.com).
3. This Agreement and all the Guidelines incorporated by reference constitute the entire Agreement between the parties pertaining to the subject matter it contains and supersedes all prior agreements and understandings between the parties. No amendment, modification or supplement of any provision of this Agreement will be valid or effective unless made in accordance with the express terms of this Agreement. Our suppliers, subcontractors and agents are third-party beneficiaries of this Agreement.
